# Florida Chapter 287 check

## Who this applies to

Chapter 287 Part I's competitive solicitation rules (ss. 287.042, 287.057, 287.058) bind an
"agency" as defined at s. 287.012(1), meaning a unit of the executive branch of state government,
and expressly exclude the universities and colleges. A county, city, school district, airport
authority or other independent special district is not an agency under Part I; it is
governed by its own charter and policies, and its
protests do not run under Chapter 120 either. Only a few Chapter 287 sections reach those bodies,
chiefly s. 287.055 (the Consultants' Competitive Negotiation Act), s. 287.133 (public entity
crimes) and s. 287.135 (scrutinized companies). If the issuer is not a state agency, say so in one
sentence, name those sections as the only ones that reach it, and stop; do not apply the Part I
thresholds or the s. 120.57(3) protest notice to it.

rather than only naming it. Chapter 287 is too large for one file and is split in two at s.
287.059, with the chapter index reproduced at the top of the first part, so `grep` for the section
number and read the region around the hit. Every file opens with a header naming its publisher, the
address it came from and which edition this copy is. Where the bundled copy and the publisher's
current version differ, the publisher's version governs and this copy is stale, which matters more
here than elsewhere because the Legislature amends this chapter most years.

**Chapter 60A-1 carries repealed rules alongside live ones**, and a repeal shows only in the
History line beneath the rule's own heading, so a grep that stops at the heading reads as though
the rule is in force. 60A-1.012, Purchasing Categories and Adjustments Thereto, was repealed on
2 February 2011, which matters because it is the obvious-looking place to find the category
thresholds. They are in s. 287.017 of the statute instead. Read the History line before citing
anything from that chapter.

Chapter 119 on public records and Chapter 255 on public construction are not bundled. A point that
turns on either is one to name as unchecked, with the source, rather than one to answer from
memory. The s. 287.055 continuing-contract cap moves every 1 July with the consumer price index
and the Department of Management Services publishes the figure, so never state a figure for it.

## Do this

1. Read the whole document. Identify the issuing agency, the solicitation type
   (invitation to bid, request for proposals, invitation to negotiate) and the estimated or stated
   contract value.
2. Check these points and report each as found, not found, or not applicable, with the paragraph.
   Before you report a point, grep the bundled file named beside it, and take every threshold from
   the statute rather than from memory, because these figures are amended:
   - The solicitation type matches s. 287.057 for the value, and the categories themselves are at
     s. 287.017, so read both before deciding.
   - The evaluator and negotiation team requirements at s. 287.057(17) are met for the value.
   - The bid protest notice under s. 120.57(3) and Rule 28-110 appears, with the notice-of-intent
     window, the formal protest window and the protest bond requirement, each quoted from
     `fl-statutes-120-57-...`.
   - The scrutinized companies certification (s. 287.135) and the public entity crime statement
     (s. 287.133) are required of vendors.
   - Public records obligations for contractors under s. 119.0701 are stated. That section sits in
     Chapter 119, which is not bundled, so check that the document addresses it and do not quote it.
   - Electronic posting on the Vendor Bid System or MyFloridaMarketPlace is referenced, and the
     procedure at 60A-1 is followed.
   - Where the document describes an evaluation or negotiation meeting, it is noticed and open as
     s. 286.011 requires.
3. Suggest an edit only where the fix is wording inside this document for one of the points above;
   otherwise describe the gap in one line.
4. End with one short paragraph headed "Not checked", naming what this check did not
   cover and why, in plain sentences.
