# FAR check

## Who this applies to

The FAR binds a federal executive agency acquiring supplies or services by contract with
appropriated funds (FAR 1.104, FAR 2.101). It does not bind a state, county, city, school district
or airport authority, and a federal grant does not bring it with the money: grants are assistance,
not acquisition, and their conditions come from 2 CFR 200 instead. If this document is a grant or a
state or local solicitation, say so in one sentence and stop; do not apply FAR clauses to it.

Two FAR texts are in force at this edition. The Revolutionary FAR Overhaul has issued rewritten
model text for fifty-one parts, adopted agency by agency as class deviations, and the Department
of War directs use of the overhaul definitions in lieu of FAR 2.101. This check therefore names
clauses as they appear in the document and reports the thresholds that are identical in both
texts; it does not decide which text binds the issuing agency, and it says so under "Not checked".
A Department of War solicitation also carries the DFARS, which is a separate check.

The rules this check cites are bundled under `reference/`, so quote the rule itself
rather than only naming it. The files are whole parts and are large, which is why you should
`grep` for the citation you want and read the region around the hit rather than reading a file
from end to end. Every file opens with a header naming its publisher, the address it came from and
which edition this copy is. Where the bundled copy and the publisher's current version differ, the
publisher's version governs and this copy is stale, so say that rather than presenting the bundled
wording as necessarily current.

FAR Part 19 is not bundled, so a question that turns on the set-aside procedures rather than on the
clause text is one to name as unchecked rather than to answer from memory.

## Do this

1. Read the whole document. Identify the issuing agency, the solicitation or
   contract number, the contracting officer, whether it uses the commercial products and services
   procedures of FAR Part 12 (look for 52.212-1 through 52.212-5), and whether the agency has
   adopted an overhaul class deviation for the parts cited.
2. Check these points and report each as found, not found, or not applicable, with the paragraph.
   Before you report a point, grep the bundled file named beside it, because the wording of the
   rule is what decides whether the document satisfies it:
   - The contracting officer is named and the document says who may bind the Government
     (FAR 1.601, 1.602-1, in `far-part-1-...`).
   - SAM registration and the Unique Entity ID requirement appear (52.204-7, 52.204-13, in
     `far-52-204-...`).
   - If Part 12 applies: 52.212-1 instructions to offerors, 52.212-3 representations and
     certifications, 52.212-4 terms and conditions, and 52.212-5 statute-implementing clauses are
     each present or incorporated by reference, and any additions to 52.212-4 are called out. The
     prescription is at 12.301 and the clause text is in `far-52-212-...`.
   - Any set-aside (small business, 8(a), HUBZone, SDVOSB, WOSB) is stated with its NAICS code and
     size standard, and where 52.219-6 is used its limitation on subcontracting is addressed.
   - The dollar thresholds the document relies on are the current ones. Read the simplified
     acquisition threshold and the micro-purchase threshold out of 2.101 in `far-part-2-...` and
     quote them, rather than stating a figure from memory, because both are adjusted for
     inflation every few years and a superseded figure is the commonest error in this check.
   - Evaluation basis (lowest price technically acceptable, best value tradeoff) is stated.
   - Offer due date and time, and the period for acceptance of offers, are stated and do not
     conflict anywhere in the document.
3. Suggest an edit only where the fix is wording inside this document for one of the points above,
   such as a conflicting due date or a superseded identifier; otherwise describe the gap in one line.
4. End with one short paragraph headed "Not checked", naming what this check did not
   cover and why, in plain sentences.
